Terms of Use

1. Agreement

These Terms of Use govern your use of Geolapis Property Intelligence (the “Service”), provided by Geolapis Inc. (“Geolapis”, “we”, “us” or “our”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and the limitations described in the Decision-Support Disclaimer.

If you do not agree, do not create an account or use the Service.

2. What the Service does

Property Intelligence helps users organize property information, buyer priorities, ownership-cost assumptions, environmental screening evidence, structured condition evidence, explainable planning scores, and Property Decision Passport records.

Important: the Service is a decision-support and evidence-organization tool. It is not a property appraisal, valuation, legal opinion, engineering report, environmental site assessment, home inspection, insurance decision, mortgage approval, tax opinion, or instruction to buy, negotiate, wait, or avoid a property.

3. Your account

  • You must provide accurate account information and keep your credentials confidential.
  • You are responsible for activity performed through your account unless you promptly notify us of unauthorized use.
  • You must have legal capacity to enter into these Terms. If local law requires parental or guardian involvement, you may use the Service only with that involvement.
  • We may restrict or suspend access where reasonably necessary for security, abuse prevention, fraud prevention, legal compliance, or material breach of these Terms.

4. Property and evidence information

You are responsible for confirming information you enter or approve, including addresses, coordinates, asking prices, lifecycle details, buyer assumptions, condition evidence, and user-supplied links. Automated or inferred values may be incomplete or wrong and must not be treated as verified merely because they appear in the Service.

Environmental and public-record evidence may have geographic, temporal, licensing, resolution, completeness, or provider-coverage limitations. A missing result does not necessarily mean a hazard, condition, record, or restriction is absent.

5. Scores, Passports and professional review

Scores and Passport outputs are based on the information and evidence available at the time of calculation. They may change when inputs, evidence, assumptions, or source data change. Confidence and limitations should be reviewed together with any score.

Before making a material property decision, obtain the inspections, legal advice, financing advice, valuation/appraisal, insurance review, engineering or environmental review, title review, planning review, and other professional advice appropriate to your circumstances.

6. Paid Property Decision Passport

Where paid access is offered, the price and currency shown by the Service at checkout control the transaction. The current paid product is a one-time, property-scoped Property Decision Passport with the access period and included refresh rights shown before payment. It is not a recurring subscription unless a future checkout expressly says otherwise.

Payment processing may be provided by Stripe or another payment provider. Geolapis does not receive or store your full payment-card number through the Property Intelligence application.

Refunds and cancellation rights are governed by applicable law and any refund terms presented at checkout. Nothing in these Terms limits non-waivable consumer rights.

7. Acceptable use

You may not use the Service to break the law, interfere with security, gain unauthorized access, evade rate limits, introduce malicious code, misrepresent Service outputs as certified professional opinions, or infringe third-party rights or data licences.

8. Intellectual property

Geolapis retains its rights in the Service, software, product design, scoring logic, documentation, branding, and generated presentation formats. You retain your rights in content you submit. You grant Geolapis the limited rights needed to host, process, reproduce, and display submitted content for providing, securing, supporting, and improving the Service.

9. Third-party services

The Service may rely on hosting, database, email, mapping, geocoding, public-data, environmental-data, and payment providers. Third-party services can change, become unavailable, or return incomplete information. Where a third-party service has its own terms, those terms may also apply to your direct use of that service.

10. Availability and changes

We may update the Service, evidence providers, features, models, security controls, or these Terms. We do not guarantee uninterrupted availability. If we make a material change to these Terms, we may require renewed acceptance before continued use.

11. Disclaimers and liability

The Service is provided on an “as available” basis. To the maximum extent permitted by applicable law, Geolapis does not guarantee that every property fact, source, score, report, provider response, or calculation is complete, current, error-free, or suitable for your specific transaction.

To the maximum extent permitted by applicable law, Geolapis will not be liable for indirect, incidental, special, consequential, or punitive loss arising from reliance on the Service. This section does not exclude liability or consumer rights that cannot lawfully be excluded or limited.

12. Governing law

These Terms are governed by the laws applicable in Ontario and the federal laws of Canada applicable there, without limiting any mandatory rights you have under the consumer-protection laws that apply to you.
